BREAKING NEWS! The full Third Circuit Court of Appeals unanimously upheld its January 2023 ruling that LTL Management was not in financial distress when it filed for bankruptcy; therefore, its bankruptcy petition should be dismissed. This ruling effectively halts LTL Management’s continued efforts to abuse the bankruptcy system to contain its talc liability. Johnson & Johnson’s LTL Management has stated its intent to appeal this decision to the United States Supreme Court. Our office will continue to monitor the status of LTL Management’s bankruptcy ploy and will update you as those efforts continue.
